Affiliate Program

By registering for our program you agree to the terms and conditions below:

1. Term of the Agreements: The term of this Agreement will begin upon our acceptance of your Affiliate application and will end when terminated by either party. Acceptance of an Affiliate Application is at the sole discretion of Secrets In Lace; the applicants web traffic will weigh heavily on our decision. Either party may terminate this Agreement at any time, with or without cause, for any reason without notice. You are only eligible to earn referral fees on sales occurring during the term.

2. General Provisions: The referral program pays 10% of new sales by referring affiliates on that visit. Secrets In Lace can not be responsible for referrers who create bookmarks and return at a later time to make a purchase. As an affiliate of the Secrets In Lace Referral Program it is your responsibility to be sure links are correct so you may be properly credited. You will always promote the Secrets In Lace website accurately and honestly. SecretsInLace.com and its representatives have the right to suspend, cancel, or deny affiliates at any time for any reason and without notice. By joining the referral program you agree to not hold SecretsInLace.com, the Secrets In Lace Referral Program, Secrets In Lace Retail Group, Secrets In Lace, or any of its representatives responsible for losses, problems, software glitches, technical problems, payouts, or any other problem resulting from your affiliation with the Secrets In Lace Referral Program. You will become eligible to request an affiliate payout only after reaching commissions valued at $25.00 or $250.00 in sales. All terms and payouts are subject to change at any time and without notice.

3. Placement of Affiliate Links and Referral Target Link: Secrets In Lace will inspect the placement of our Affiliate Link and determine if it is sufficient to generate referrals and sales; Secrets In Lace discourages the placement of our Affiliate Link in "Banner Farms" or on pages with more than 5 links; Secrets In Lace requires its Affiliates to link only to our home page at www.secretsinlace.com as specific product links may change; if the link is not prominent or does not appear in the top 3 links on a page,is improperly placed or does not conform to the guidelines stated in the "Terms and Conditions" Secrets In Lace may immediately terminate the agreement.

4. Intellectual Property Rights: Affiliates may use banners provided by Secrets In Lace or banners approved by Secrets In lace. Affiliates do not have permission to use Secrets In Lace photography at any time. Unless otherwise indicated, this site and its contents (including, but not limited to, all text, photographs, images, video, and audio) are the exclusive property of Secrets In Lace Retail Group, Incorporated and are protected by copyright, trademark, trade dress, and other laws.

   You may view and download a single copy of the material on this site for your personal use only. No right, title or interest in any downloaded or copied material is conveyed to you as a result of any such downloading or copying, and such downloaded or copied material may not be used for any commercial purpose, other than to purchase merchandise from us. You must retain all copyright and other proprietary notices contained in the original material on any copy you make of the material on this site. You may not reproduce, publish, transmit, distribute, perform, display, modify, create derivative works from, sell, or otherwise exploit this site or any of its contents without our prior written permission. The use of any portion of this material on any other Web site or in a networked computer environment for any purpose is prohibited. Unauthorized use of this material violates copyright, trademark, and other laws. In addition, if you violate any of these terms, your permission to use the site material automatically terminates and you must immediately destroy any copies you have made of the material.

5. Modification: We may modify any of the terms and conditions contained in this Agreement, at any time and at our sole discretion, by posting a new agreement on this site. Modifications may include, for example, changes in the scope of available referral fees, fee schedules, payment procedures and Program rules. IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOUR ONLY RECOURSE IS TO TERMINATE THIS AGREEMENT. YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING OUR POSTING A NEW AGREEMENT ON OUR SITE WILL CONSTITUTE BINDING ACCEPTANCE OF THE CHANGE.

6. Limitation of Liability: We will not be liable for indirect, special or consequential damages, or any loss of revenue, profits or data, arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total referral fees paid or payable to you under to this Agreement.

7. Independent Investigation: YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU UNDERSTAND THAT WE MAY AT ANY TIME (DIRECTLY OR INDIRECTLY) SOLICIT CUSTOMER REFERRALS ON TERMS THAT MAY DIFFER FROM THOSE CONTAINED IN THIS AGREEMENT OR OPERATE WEB SITES THAT ARE SIMILAR TO OR COMPETE WITH YOUR WEB SITE. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.

8. Miscellaneous: This Agreement will be governed by the laws of the Commonwealth of Virginia without reference to rules governing choice of laws. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of and be enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
